Terms of Service

1) Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of Tooth Guides apps, websites, and services (the “Services”). By creating an account, downloading, or using the Services, you agree to these Terms.
2) Who May Use the Services
You must be at least 13 years old (or the age of digital consent in your region). If you are using the Services on behalf of a dental practice, you represent that you are authorized to bind that practice to these Terms.
3) Important Medical & Emergency Disclaimers
- The Services provide educational and after-care guidance content only. They are not a substitute for professional diagnosis or treatment.
- The Services do not create a dentist–patient relationship.
- In a medical or dental emergency, call 911 or your local emergency number immediately.
4) Accounts & Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use: support@theoncallbot.com.
5) Subscriptions, Trials, and Billing
Some features require a paid subscription after a free trial. Subscriptions auto-renew until cancelled. Manage or cancel via your Apple App Store or Google Play account settings, or as otherwise provided. Taxes may apply. Paid amounts are non-refundable except as required by law or our posted refund policy.
6) License and Acceptable Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. You agree not to:
- copy, modify, reverse engineer, or attempt to derive source code;
- interfere with or disrupt the Services;
- use the Services for unlawful, infringing, or harmful purposes;
- upload malicious code, or attempt unauthorized access;
- misrepresent your identity or affiliation;
- use automated means to scrape or extract data except as expressly permitted.
7) Practice/Professional Features
Dentist or practice users must ensure their use complies with applicable laws, professional standards, and privacy obligations (including any HIPAA requirements). Where PHI is processed, a Business Associate Agreement may be required (contact us).
8) User Content
You retain ownership of content you submit. You grant The Oncall Bot a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your content solely to operate and improve the Services. You represent you have the rights necessary to submit such content.
9) Third-Party Services & Links (incl. OpenAI)
We may integrate or link to third-party services (e.g., SSO, analytics, payments, messaging, and AI processing providers such as OpenAI) to operate features. When you use AI features, your prompts and related metadata may be transmitted to these providers to generate results and ensure safety/quality. Third-party services are governed by their own terms and privacy policies, including OpenAI at openai.com/policies. We are not responsible for third-party services.
10) Intellectual Property
The Services, including software, designs, trademarks, logos, and content provided by The Oncall Bot, are owned by The Oncall Bot LLC or its licensors and are protected by law. Except for the limited license in §6, no rights are granted.
11) Feedback
If you provide feedback or suggestions, you grant us a perpetual, worldwide, royalty-free right to use them without obligation to you.
12) Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, create risk, or as required by law. Upon termination, your right to use the Services ends. Sections that by their nature should survive (e.g., disclaimers, liability limits, dispute resolution) will survive.
13) Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ONCALL BOT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ONCALL BOT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.
15) Indemnification
You agree to defend, indemnify, and hold harmless The Oncall Bot LLC and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms.
16) Governing Law; Venue
These Terms are governed by the laws of the State of New York, without regard to conflicts of laws principles. Subject to §17 (arbitration), the exclusive venue for disputes shall be the state or federal courts located in New York County, New York.
17) Dispute Resolution; Arbitration; Class Waiver
You and The Oncall Bot agree to resolve disputes through binding arbitration on an individual basis administered by a recognized provider, rather than in court. You waive any right to participate in a class or representative action. You may opt out within 30 days of first acceptance by emailing support@theoncallbot.com with the subject “Arbitration Opt-Out.”
18) Changes to the Services or Terms
We may update the Services and these Terms from time to time. Material changes will be communicated in-app or via email. Continued use after changes become effective constitutes acceptance.
19) Export & Sanctions Compliance
You agree to comply with U.S. export control and sanctions laws and not to use the Services in restricted countries or for prohibited purposes.
20) Miscellaneous
If any provision is unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign in connection with a merger, acquisition, or sale of assets.
